WAREHOUSE TERMS AND CONDITIONS
CONDITION: **All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE.
**All sales are final.
**All bids are based on the inspection, evaluation, and desire of the bidder(s).
**Unless otherwise stated in an item description no items have been tested for functionality.
**You are bidding on the DESCRIBED ITEM NOT THE PHOTO(S).
** ON SITE GURANTEE means that we feel the item is working properly. The buyer will have the right to see the item working BEFORE it leaves our facility. If it does not work properly, the buyr may reject the sale and receive a full refund of the purchase price. If it does work, the WARRANTY ENDS when the piece is loaded onto the buyer's vehicle.
**Refrigeration Temperatures are not guaranteed. We report only what we found when the unit was run for a brief period.
**WORKING WHEN REMOVED means the seller (not the Auctioneer) reports item in use at time of closing. **No warranty or guarantee is provided.
**In the event, any item is lost, damaged, or stolen, before it is removed from the auction site, the buyer will be limited to a refund of the purchase price. The seller and/or Wester Auction will not be liable for more than the purchase price of any item.
PREVIEW: You may schedule an appointment to preview the items in this auction by calling Randy Wester at 984-500-9395 or John Martin at 919-522-9802. We will try to meet your schedule, but times and dates are not guaranteed. We are normally open from 9:00 AM until 5:00 PM, but we recommend that you call first.
PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES), unless you have made PRIOR arrangements with Wester Auction for an alternate form of payment.
If your credit card is declined for ANY REASON, you will have 24 hours to make full restitution, with another credit card or cash. If you fail to pay your invoice IN FULL within the first 24 hours, Wester Auction reserves the right to sell the items on your invoice.
In addition, you may be removed from our approved bidders list for future auctions.
REMOVAL: The removal period will be posted on your invoice and in the details section of the auction. Failure by the buyer(s) to meet the removal schedule may result in storage charges or the loss of your purchases, without refund.
We will provide loading assistance, but packing and securing the load will be the responsibility of the buyer.
SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)
SALES TAX: The State of NC requires us to collect sales tax for all items in this auction. If you are not from NC and the purchased items are not going to be used in NC, then you will not be charged NC sales tax. You may be responsible for paying the State's Use Tax from your state. If you are Tax Exempt, please provide the affiliate seller the appropriate Tax Exemption paperwork after you receive your emailed invoice for this sale. The sales tax will be refunded and you will not be charged sales tax in the future.
CREDIT CARD CHARGEBACKS: **Each Bidder agrees not to initiate a credit card chargeback with respect to any charges.
**Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid.
**With the Auctioneer's presentation of these Bidder Terms and Conditions to the issuing bank, credit card company, or other financial institution, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.
