This will be a live auction with Internet pre-bidding AND Internet live bidding. The building owner has new plans for the building and EVERYTHING must be cleared out. We have a great grocery refrigeration package, selling as ONE LOT. In addition, we have consignments from several Alamance County restaurants. GREAT SALE -- MAKE YOUR PLANS TO BE HERE.
TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract. WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us. The seller no longer needs these items and refuses to guarantee the condition. It is YOUR responsibility to inspect items BEFORE you bid on them. INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse. PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash or good NC check, or with a (credit/debit card - subject to a 3% processing fee). Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions. FAILURE TO SETTLE YOUR INVOICE - Any item(s) that are not paid for AND removed during the Stated Removal Period will result in your bidding privileges suspended for future auctions. Once the invoice has been settled, your bidding privileges will be re-instated. DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please come to the preview. HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment. REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid. BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 10%. This is one of the lowest in the auction industry. CREDIT/DEBIT CARD PROCESSING FEE - If you choose to use a credit or debit card to settle your invoice your buyer's premium will be increased from 10% to 13% to cover the processing fees. This allows us to keep our buyer's premium as low as possible. SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one unit and your bid will be multiplied by the number of units. REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.) REMOVAL PERIOD - The scheduled removal time will be printed on the bottom of your invoice. We do not provide manpower, tools, or equipment. PLEASE BRING YOUR OWN. Any item remaining after the SCHEDULED REMOVAL PERIOD is subject to be considered ABANDONED, with no refund or recourse to the buyer. RESERVE PRICES - The seller reserves the right to set a minimum acceptable price on any item in the auction. The seller authorizes Wester Auction to bid for the seller up to, but not above this reserve price. This notice within the terms and conditions meets the laws governing auctioneers and does not violate any law within the state of NC.

ONLINE BIDDERS -You may settle your invoice on Wednesday, November 20 when you come for your items with cash or good NC check, or with a (credit/debit card - subject to a 3% processing fee). IN PERSON BIDDERS - You must settle your invoice before leaving the auction site. You may pay with cash, good NC check, or a credit card (with a 3% increase to your buyer's premium). Failure to settle your invoice before leaving the auction site may result in your items being sold to someone else, and your bidding privileges revoked for future auctions.
