TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract.
WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us. The seller no longer needs these items and refuses to guarantee the condition. It is YOUR responsibility to inspect items BEFORE you bid on them.
INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse.
PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash, check, or with a credit/debit card. Customers paying with cash or qualified check will receive a 3% discount. Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions. At 5:00 PM on the day of removal all outstanding invoices will be charged to the card on file.
FAILURE TO SETTLE YOUR INVOICE - Any item(s) that are not paid for AND removed during the Stated Removal Period will result in your bidding privileges suspended for future auctions. Once the invoice has been settled, your bidding privileges will be re-instated.
DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please come to the preview.
HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment.
REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid.
BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 13%. Cash payment qualifies everyone for a 3% discount from the buyers premium. Qualified check writers receive the same 3% discount.
SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one one unit and your bid will be multiplied by the number of units.
REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)
REMOVAL PERIOD - The scheduled removal time will be printed on the bottom of your invoice.. We do not provide manpower, tools, or equipment. PLEASE BRING YOUR OWN. Any item remaining after the SCHEDULED REMOVAL PERIOD is subject to be considered ABANDONED, with no refund or recourse to the buyer.
INVOICE - Your invoice will be emailed to you within one hour after the auction has been completed.
ON SITE GUARANTEE - In most cases, our auctions include used, not new, items. These used items generally do not have any manufacturers' warranty. Should we offer a new item with a warranty, that information will be included in the item's description in the auction catalog.
In some cases, the seller of an item will offer an "on-site guarantee", meaning that the buyer can test the item before paying for it and removing it from the auction site. However, once the buyer pays for the item and loads it onto his/her vehicle, the "on--site guarantee" ends. Neither the seller nor the auction company can be responsible for damage to the item after it leaves the auction site.
The manufacturer's warranty, if any, and the "on-site guarantee" do not insure that the buyer's governing health department will accept any item purchased at auction. For this reason, it is wise to attend the advertised auction preview to inspect the items and contact the health department regarding items you might wish to purchase.
RESERVE PRICES - The seller has the option to require that a certain item mut bring a minimum "reserved" price. In accordance with NC Statutes the auctioneer will bid on the item up to but never above the seller's reserve price.
