Health reasons have forced this owner to close his beautiful restaurant. We are selling EVERYTHING except the walk ins, hood system, and bar, including a ONE MONTH OLD freezer and 10 month old prep cooler.
Auction Terms & Conditions NC SALES TAX - The NC Department of Revenue has told us that we must collect sales tax on any item we sell. If you are buying for resell, please make sure we have a re-sell certificate on file. TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract. WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us. The seller no longer needs these items and refuses to guarantee the condition. It is YOUR responsibility to inspect items BEFORE you bid on them. INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse. SALES TAX: The State of NC requires us to collect sales tax for all items in this auction. If you are not from NC and the purchased items are not going to be used in NC, then you will not be charged NC sales tax. You may be responsible for paying the State's Use Tax from your state. PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash, good NC check (subject to a 2% certification fee), or with a (credit/debit card - subject to a 3% processing fee). Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions. FAILURE TO SETTLE YOUR INVOICE - Any item(s) that are not paid for AND removed during the Stated Removal Period will charged to the card on file. If the card does not clear the invoice your bidding privileges will be suspended for future auctions. Once the invoice has been settled, your bidding privileges will be re-instated. DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment. REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid. BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 10%. This is one of the lowest in the auction industry. CREDIT/DEBIT CARD PROCESSING FEE - If you choose to use a credit or debit card to settle your invoice your buyer's premium will be increased from 10% to 13% to cover the processing fees. This allows us to keep our buyer's premium as low as possible. SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one one unit and your bid will be multiplied by the number of units. REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. Payment Terms
You may pay for your items with cash or good NC check when you come for them. If you choose to pay with a credit/debit card there will be a 3% processing fee. All invoices not cleared by 5:00 PM Monday will be charged to the card on file. If the card will not cover the invoice total, your bidding privileges will be suspended until the invoice is cleared.
We do not offer delivery services. If you need your items delivered call Dan Doby at 336-512-9712. We will ship items sold in this auction, since it is at our warehouse facility. The buyer is responsible for all preparation charges and shipping costs.
