TCBY has reached the end of their lease and want to pursue other interests, so they have decided to not renew their lease. We have been authorized to sell all remaining assets of the LLC.
The yogurt mchines will be going back to Taylor per contract requirements, but EVERYTHING else is here and needs to be sold.

Auction Terms & Conditions CONDITION: All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE. All sales are final.
All bids are based on the inspection, evaluation, and desire of the bidder(s). in the event any item is lost, damaged, or stolen the liability of the seller and Wester Auction will be limited to the refund of the purchase price. Color of any item IS NOT GUARANTEED.

PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice. If your credit card is declined for ANY REASON, you will have 24 hours to make full restitution, with another credit card or cash. If you fail to pay your invoice IN FULL within the first 24 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you may be removed from our approved bidders list, and not be allowed to purchase from us in the future.
REMOVAL: All items must be removed on Friday, December 30 from 10:00 AM until 5:00 PM.

All dismantling and removal will be the responsibility of the buyer. The buyer will provide all manpower, tools, and equipment necessary to do a proper job of removal while not damaging the building. The buyer will be responsible for any damage done to the building. The buyer(s) of the walk in cooler and freezer will be TOTALLY responsible to insure that the sprinkler system is not damaged or set off.
SELLING MULTIPLE LIKE ITEMS: in the event that we sell multiple like items to more than one buyer, selction will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

Immediately after the bidding ends, you will receive an invoice for the items purchased. At that point we will charge the full invoice to the credit card on file that you usd to register for the auction.
If for any reason your credit card is declined, you will have 24 hours to make full payment with either another credit card, cash, or cashiers check. If settlement is not completed within the 24 hour period following the end of the auction, we reserve the right to void the sale and sell your items to another bidder. You will then be removed from the approved bidders list for any future auctions.
