Auction Terms & Conditions SPECIAL NOTE------ This auction is being conducted by Wester Auction & Realty, Inc. under the KY license of James R. Wester (license number 4117). CONDITION: **All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE. **All sales are final. **All bids are based on the inspection, evaluation, and desire of the bidder(s). **In the event, any item is lost, damaged, or stolen, before it is removed from the auction site, the buyer will be limited to a refund of the purchase price. The seller and/or auctioneer will not be liable for more than the purchase price of any item. ______________________________________________________________________________ PREVIEW: You may preview the items in this auction on Monday, February 13 from 10:00 AM until 3:00 PM. ______________________________________________________________________________ PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES). If your credit card is declined for ANY REASON, you will have 24 hours to make full restitution, with another credit card or cash. If you fail to pay your invoice IN FULL within the first 24 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you will be removed from our approved bidders list for future auctions. ______________________________________________________________________________ REMOVAL: Tuesday and Wednesday, February 14 & 15 from 10:00 AM until 5:00 PM. This removal period will be posted on your invoice and in the details section of the auction. Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund. The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility. In the case of a large built-in item (walk in cooler, etc.) the buyer may be required to hire a professional removal company, that is fully qualified and insured. The auction company will have one person on site to insure that you have access and do not damage the building. This person will not be responsible for watching your items or assisting you with loading. ______________________________________________________________________________ SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.) ______________________________________________________________________________ SALES TAX: The State of KY requires us to collect 6% sales tax on all of the items sold in this auction.
